Welcome to KwoTit. By signing up for an account, using our platform, embedding our widgets, or otherwise accessing any part of our Services, you agree to be bound by these Terms of Service and our Privacy Policy.
Please read these Terms carefully. They affect your legal rights, including how subscriptions, content ownership, warranties, and liability are handled.
1. Acceptance of These Terms
By visiting our website, creating an account, embedding our widgets, or using our platform, you confirm that you have read, understood, and agree to these Terms.
If you are using our Services on behalf of a company, school, organization, or other entity, you confirm that you have the authority to bind that entity to these Terms, and "you" refers to both you and that entity.
If you do not agree to these Terms, you must not access or use our Services. Continued use of our Services after reviewing these Terms means you accept them in full.
2. Changes to These Terms
We may update or change these Terms at any time for legal, regulatory, business, or security reasons. Updated Terms will be posted on this page with a revised "Last Updated" date.
For active accounts, material changes that significantly affect your rights or obligations will, where reasonably possible, also be communicated to you directly (for example, by email or Signup notification).
Your continued use of our Services after any changes take effect constitutes acceptance of the revised Terms. We encourage you to review this page periodically.
3. Eligibility & Account Registration
To use our Services, you must be of legal age to enter into binding contracts in your country of residence, or have the consent of a parent or legal guardian.
When creating an account, you agree to provide accurate, current, and complete information, and to keep that information up to date. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
You must notify us immediately of any unauthorized use of your account or any other security breach. KwoTit will not be liable for any loss or damage arising from your failure to protect your account.
4. Description of Services
KwoTit is a platform that allows businesses to build, customize, and publish interactive quote calculators. Our Services include, but are not limited to:
- Calculator Builder: A drag-and-drop tool to create custom quote calculators with questions, pricing, and conditional logic.
- Embeddable Widgets: Code snippets that businesses can place on their websites to display their calculators.
- Standalone Quote Pages: Dedicated, shareable URLs for each calculator — no website needed.
- Signup: A management interface where businesses can view and manage calculators, leads, and settings.
- Industry Templates: Pre-built calculators for industries such as 3D printing, tailoring, furniture, and more.
- Lead Management: Tools to track and manage quote requests submitted through your calculators.
Descriptions of Services on our website are for general informational purposes and may be updated, modified, or discontinued at any time without prior notice.
We reserve the right to refuse, limit, or cancel any account or service at our discretion, including where we believe it conflicts with these Terms or our ability to deliver quality service.
5. Account Types & Subscriptions
5.1 Free Account
A Free account includes access to basic features of the platform, subject to usage limits (such as a maximum number of calculators or lead submissions). Free accounts may display KwoTit branding on the widget and within the Signup. Free accounts are provided "as is" and may be subject to change or discontinuation at any time.
5.2 Paid Subscriptions (Pro & Lifetime)
Paid subscriptions unlock additional features, higher usage limits, white-label branding, and priority support. Subscription fees are billed in advance on a monthly or one-time basis, depending on your selected plan. All fees are non-refundable except as required by law or as expressly stated in these Terms.
We reserve the right to change subscription fees at any time. Fee changes will be communicated to you in advance and will apply to your next billing cycle. Your continued use of the Services after any fee change constitutes your acceptance of the new fees.
5.3 Cancellation & Downgrade
You may cancel your subscription at any time through your Signup. Upon cancellation, your account will revert to the Free plan at the end of your current billing period. No refunds will be issued for partial subscription periods. If you cancel while on a paid plan, you will lose access to paid features at the end of your billing cycle.
6. White-label Widget & Branding
KwoTit provides embeddable widgets that you can place on your website or share as standalone pages. The appearance and branding of the widget are controlled by you through your Signup settings (such as brand color, logo, business name, and intro message).
Free Plan: The widget will display "Powered by KwoTit" or KwoTit branding, and you may not remove or obscure this attribution.
Pro & Lifetime Plans: You may remove KwoTit branding from the widget, and the widget will display only your business name, logo, and brand colors.
You are solely responsible for the content, accuracy, and use of the information collected through the widget on your website. KwoTit is not responsible for any claims, liabilities, or damages arising from the use of the widget on your website.
7. Intellectual Property
7.1 KwoTit Platform
KwoTit owns and retains all rights, title, and interest in and to the platform, including all software, code, algorithms, designs, templates, documentation, and related intellectual property. You may not copy, modify, reverse-engineer, decompile, or create derivative works of the platform or any part of it, except as expressly permitted by these Terms.
7.2 Your Content & Data
You retain ownership of any data, content, or information you create through the platform, including calculators, questions, pricing, customer information, and lead data. By using the platform, you grant KwoTit a non-exclusive, worldwide, royalty-free license to store, process, and display your content solely as necessary to provide the Services.
7.3 Widget & Embed Code
The embed code and widget scripts provided by KwoTit are proprietary and may only be used as part of your active KwoTit account. You may not distribute, sublicense, or resell the widget or embed code to third parties. Embedding the widget on your website for your own business purposes is permitted, provided you comply with these Terms.
7.4 Usage Data
KwoTit may collect and analyze usage data, anonymized statistics, and aggregated information to improve the platform, develop new features, and understand user behavior. This data will not identify you or your customers personally and may be shared with third parties in aggregated, anonymized form.
8. Customer Data & Privacy
As a business using KwoTit, you may collect personal information from your customers through the widget (such as names, email addresses, phone numbers, and project details). You are responsible for complying with all applicable data protection and privacy laws regarding the collection, storage, and use of your customers' information.
KwoTit processes customer data on your behalf as a data processor. We process data only as necessary to provide the platform and as directed by you. We implement reasonable security measures to protect customer data. However, no method of transmission or storage is 100% secure, and KwoTit cannot guarantee absolute security.
KwoTit may retain anonymized and aggregated data derived from your use of the platform for analytical and improvement purposes, but we will not retain or use your customers' personal information for our own purposes without your consent.
If you are subject to the GDPR or other privacy regulations, you agree to obtain any necessary consents from your customers before collecting their information through the KwoTit widget.
9. Acceptable Use
You agree not to use our platform to:
- Engage in any unlawful activity;
- Infringe the intellectual property or other rights of any person;
- Collect sensitive personal information (such as health data, financial account numbers, or government IDs) without explicit consent and appropriate security measures;
- Send spam, unsolicited messages, or fraudulent communications;
- Harass, defraud, or mislead any person;
- Interfere with, disrupt, or attempt to gain unauthorized access to our platform or infrastructure;
- Use the platform to create calculators for prohibited, illegal, or regulated products or services;
- Resell, sublicense, or redistribute the platform or widget without our prior written permission.
KwoTit reserves the right to suspend or terminate your account if we reasonably believe you have violated this Acceptable Use policy, without obligation to refund any amounts paid.
10. Service Availability & Support
We work to keep the platform available and functioning correctly, but we do not guarantee uninterrupted, error-free, or continuous availability. We may suspend, restrict, or modify any part of the platform — including for maintenance, upgrades, security reasons, or due to factors outside our control — without liability for any resulting loss or inconvenience.
Support is provided through our Help Center, documentation, and email. Pro and Lifetime subscribers receive priority support with faster response times. Response times are estimates only and are not guaranteed.
11. Warranties & Disclaimers
Our platform and services are provided on an "as is" and "as available" basis. While we take care to deliver quality service, we do not guarantee that the platform will be error-free, uninterrupted, or fit for any particular purpose beyond what is explicitly described in these Terms.
To the maximum extent permitted by applicable law, KwoTit disclaims all other warranties, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement, except where such warranties cannot be lawfully excluded.
KwoTit is not responsible for the accuracy, completeness, or reliability of any quotes, estimates, or calculations generated through the platform. You are responsible for reviewing and verifying any quote before presenting it to your customers.
12. Limitation of Liability
To the maximum extent permitted by applicable law, KwoTit's total liability for any claim arising from or related to the platform or services shall not exceed the total amount you paid to KwoTit in the twelve (12) months preceding the claim, or GHS 500.00, whichever is greater.
KwoTit will not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, revenue, data, goodwill, or business opportunities, even if we have been advised of the possibility of such damages.
KwoTit is not responsible for any decisions made or actions taken by you or your customers based on quotes or estimates generated through the platform.
13. Indemnification
You agree to indemnify and hold harmless KwoTit, its founder, employees, contractors, and partners from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising from or related to: (a) your use or misuse of the platform; (b) your violation of these Terms; (c) your violation of any law or the rights of a third party; (d) any content, data, or materials you provide to or through the platform; or (e) any quotes, estimates, or representations made by you to your customers using the platform.
14. Termination & Suspension
Either party may terminate this agreement by providing written notice to the other. Upon termination, your access to the platform and Signup will be disabled, and any data stored on the platform may be deleted. No refunds will be issued for unused subscription periods.
KwoTit may suspend or terminate your access to the platform if: you breach these Terms; payments are overdue; you engage in abusive, fraudulent, or illegal conduct; or continuing to provide Services would expose KwoTit to legal or reputational risk.
Upon termination, you must cease using the platform and widgets immediately, and remove all KwoTit embed codes from your websites.
15. Third-Party Services
Our platform relies on and integrates with third-party services, including but not limited to Supabase for database and authentication, Paystack for payment processing, and hosting providers. These third parties operate under their own terms and privacy policies, which we encourage you to review.
KwoTit is not responsible for outages, errors, policy changes, or actions taken by these third-party platforms, although we will make reasonable efforts to inform you of any significant impact on your use of the platform.
16. Dispute Resolution
If a dispute arises between you and KwoTit relating to these Terms or the platform, both parties agree to first attempt to resolve the matter informally through good-faith discussion.
If the dispute cannot be resolved informally within a reasonable period, it will be subject to the exclusive jurisdiction of the courts of Ghana, unless the parties agree in writing to an alternative dispute resolution method, such as mediation or arbitration.
17. Governing Law
These Terms, and any dispute arising from or related to them or the platform, are governed by and interpreted in accordance with the laws of Ghana, without regard to conflict-of-law principles.
18. Severability
If any provision of these Terms is found by a court or other authority to be invalid, illegal, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions of these Terms will continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and KwoTit regarding the platform, and supersede any prior discussions, understandings, or agreements, whether written or verbal.
